Judge Masipa slams Pistorius with five year prison sentence

Pistorius escaped a more severe charge of premeditated murder after he shot his girlfriend, Reeva Steenkamp, at his Pretoria home.

Masipa says the appropriate sentence was supposed to find the balance in both restorative justice and correction of the offense committed.

“The sentence should not be too light that the victims end up taking the law into their own hands or too severe that it [destroys] the accused,” she said.

Masipa unpacked case laws setting differences and precedence before she handed down the sentence.

Earlier on submissions, the state argued for 10 years in prison saying a lesser sentence would not be welcome by the society.

“It is impossible to deal with the interest of the society without mention of the deceased's parents,” said Masipa.

“We should however differentiate between public interest and what the society wants,” she added.

Pistorius’ contribution to various social projections and perception about disabled people played a role in Judge Masipa’s sentence.

“The accused inspired the disabled as he grew and excelled in his career that saw him competing even with people without disabilities,” she said.
