In their paper
“The Rise of the Regulatory State,”Harvard University economists
Edward Glaeser and Andrei Schleifer wrote “whatever law enforcement strategy
the society chooses, private individuals will seek to subvert its workings to
benefit themselves.” In recent years, few African countries have exhibited that
theory better than South Africa. 



Before the ousting of the allegedly corrupt former president, Jacob Zuma, South Africa was engrossed in a web of corruption characterised as “state capture”: a severe level of corruption where private individuals influence the state to such an extent that they almost assume ownership of the state’s resources. 



At the center of
the web were the Gupta brothers, who rose to such prominence in South Africa
that <a href="https://www.nytimes.com/2018/12/22/world/africa/gupta-zuma-south-africa-corruption.html">The
New York Times</a> reported “it became difficult to draw the
line between their business empire and the president’s office.” From high-level
cabinet appointments to the South African Revenue Services, corruption
permeated virtually every element of society, with much of it involving the
country’s leading political party, the ANC.



But things appear
to be looking up for South Africa, where newly elected leader Cyril Ramaphosa
has <a href="https://www.bbc.com/news/world-africa-48252097">vowed to tackle
corruption</a>. In March he established a new Investigating Directorate within
the National Prosecution Authority (NPA). And since his election, various party
leaders facing corruption probes by the ANC Integrity Commission have delayed
taking their seats in parliament or have declined to do so. 



While holding
corrupt leaders accountable sends a powerful message, if Ramaphosa’s long-term
strategy does not include investments in innovations that lead to prosperity
creation, he’s effectively snipping the buds while the roots remain intact.



For many,
engaging in corruption is simply a workaround—a means of making progress when
few better options exist. But the corrupt behavior exhibited by those within
the highest levels of government is something entirely different: the result of
an imbalance of power, in which those who have it use it to exploit those
without it. In contrast to the wealth and power of Zuma and the Gupta brothers,
more than half of South Africans live below the poverty line. Without financial
and political resources, it&#8217;s difficult for people living in poverty to
advocate for themselves. Thus, Zuma and his cronies succeeded in siphoning
funds away from public projects and programs for years because those who bore
the cost—the South African people—couldn’t do much about it. 



Ramaphosa’s best
shot at making a dent in corruption, then, is to not only investigate corrupt
individuals—a necessary short-term approach—but to also to double-down on his
market-oriented approach to development. If he’s able to help his country
become more prosperous, South Africans will not only have more bargaining
power, but the government will also be less vulnerable to exploitation and
better equipped to fight corruption.



To achieve this
goal, his government can support investments in market-creating innovations
that solve everyday problems. Unlike other types of innovations, our research
has found that these innovations create the foundation for robust, sustainable
growth by transforming complex and expensive products into simple and
affordable ones, allowing more people to participate in the economy. They
create jobs, result in investments in infrastructure, and provide much-needed
tax revenue to the government that can then be reinvested in communities and
anti-corruption efforts. They also tend to <a href="https://www.christenseninstitute.org/blog/to-strengthen-institutions-good-laws-are-not-enough/">strengthen
institutions</a> once stronger legislative systems and more contextual
regulations become essential to sustaining and growing the new markets. In
short, these powerful innovations spur significant economic development, while
creating the conditions for good governance. 



As people become
more prosperous and drive economic growth, the power dynamic shifts such that
government leaders become more responsive to the people’s needs, recognizing a
mutual interest in seeing the economic engine of their country succeed. This is
exactly what happened in the United States, where corruption ran rampant from
the mid-19th century until the early 20th century. But as more Americans
created more wealth for themselves, their voices of dissatisfaction with
corruption became louder. “Politically, the rage of victims counted for very
little in 1840, not much in 1860; by 1890, it was a roaring force” is how
Stanford Law Professor <a href="https://www.amazon.com/History-American-Law-Third/dp/0684869888">Lawrence
Friedman</a> put it.



Corruption can be
found in virtually every country across the globe, but it’s especially
difficult to squash wherever people lack the ability to advocate for their own
interests, and governments lack the ability to adequately respond to their needs.
To that end, Ramaphosa must play the short game and the long game—trim the buds
and pull out the roots. By encouraging investments in market-creating
innovations, he can spearhead a new era of development, while simultaneously
creating the conditions for corruption to plummet and a stable, responsive
government to take its place.

Former President Jacob Zuma said the “Zuma must go”&nbsp;campaign
of 2017 where hundreds of thousands&nbsp; of South Africans took to the streets
to protest against him was part of the intelligence-fuelled campaign to vilify
him that upset his family.



Zuma was giving evidence to the Zondo Commission on State Capture in Johannesburg where he is expected to answer questions on the controversial Gupta family and alleged corruption in the function of the government of his day.

“People were calling,&nbsp;
Zuma must go. What can be done? No one can do anything he is corrupt.
What has he done ? Nothing. No president has been brought before a commission
but if it is Zuma we must do it…Zuma must resign. It is part of the
intelligence plan against me. Then he must be brought before the commission and
answer questions,” he said.



Zuma sounded a little bitter as he hinted that he was going
to retaliate and told of the pain suffered by his family. 



I have been provoked and provoked to the last degree, by
people purporting to save the country they make stories they do everything. My
own family suffered out of this leaving me, as a soldier I can take everything,
people forget I have a family who do not want to hear lies being told against
me.”

#StateCaptureInquiry: The Zuma must go campaign was part of the conspiracy

Former President Jacob Zuma made it clear his comrades were out to get him when he began giving evidence to the Zondo Commission in Johannesburg.



Supporters clapped and cheered as Zuma walked into the
hearing where he is expected to answer scores of questions for the rest of the
week on everything from the controversial Gupta family to the hundreds of
thousands he is alleged to have taken as a bribe every from the security
company BOSASA. Zuma told the hearing that he was there because he
believed&nbsp;it was important that people say things they know, that than
telling things they can’t prove.



“Ï have been vilified over the years!” Zuma told the commission
clearing his throat&nbsp;frequently and blaming a bout of flu.



This commission from my understanding was really created to
have me coming here and perhaps to find things on me…This is why, in the
background I am going to give&#8230;There has been a drive to remove me from
everything a wish that I should disappear…Why it is important I will deal
with…Work in the ANC and also because of who I am…This conspiracy against me
has been stressed at all material times when there are things to be done. It
has come in different forms and that is why people who are trying to dodge
things in one thing or another. I am going to connect the dots as to why I am
here.”



Zuma claimed that three intelligence organisations, one from
South Africa, in 1990 decided to remove Zuma, then head of ANC intelligence,
from all structures in the party. He claimed it was a clear character assassination
on the grounds that he had information that his party had been infiltrated by
spies.



Zuma also claimed his removal from power in 2005, in
reaction to South Africa’s controversial arms deal, smacked of a campaign
against him.



“Before I was charged, I was removed as deputy president in
2005 because I was implicated in the arms deal. Of all the people implicated in
the arms deal there was not a single one investigated but they investigated me.
I had been investigated in a very strange way, the head of the NPA and the
minister where they announced there is a prima facie case against him but it is
not winnable in court. There are investigations and then there are
investigations. I have never heard of an investigation against anyone being run
like that in the media.”

It didn&#8217;t take long for the name of the notorious Gupta brothers – who once made millions selling coal in South Africa with questionable contracts – to be dragged into the big shake up at Africa’s biggest power generator.
The brothers left South Africa, this year, after two decades of business in South Africa that garnered them a multi-billion rand fortune. Their critics claim they used political influence to secure many of these contracts to supply coal to Eskom from their operations under Tegeta Resources at premium prices at the last minute to ease shortages.
“It (Eskom) would sign midnight contracts with Tegeta to get coal pre-payments of hundreds of millions of rand that were given. There would be teleconferences to make sure the Guptas got the deal,” says Pravin Gordhan the minister of public enterprises.
“The idea was to squeeze everyone else out of the market and make the Guptas dominant. Now they (Eskom) are telling us it takes a year to sign such contracts. There is something wrong in this kingdom, so to speak.”
Gordhan also said he was concerned about the cost of diesel to run Eskom’s emergency open cycle gas turbines that are used to prop up the grid. He said a team of independent advisers were going to look at this cost.
“They were spending a billion rand a month to keep the lights on” There has to be a use of diesel but it is something you want to minimise.”
The Guptas left for Dubai earlier this year and most of their businesses have been sold off or liquidated.

Guptas and midnight contracts castigated in Eskom shake up

JOHANNESBURG (Reuters) &#8211; South Africa’s Finance Minister Nhlanhla Nene said on Wednesday he was fired by former president Jacob Zuma for refusing to approve contracts that would financially benefit the Gupta family, friends of Zuma accused of corruption.
Nene, who was giving testimony at a judicial inquiry into influence-peddling, said the main reason he was he was sacked was for rejecting a proposed plan to build a fleet of nuclear power plants. The project could have cost up to $100 billion.
Zuma and the Gupta family deny allegations they colluded to inappropriately divert state funds.

#StateCaptureInquiry: Zuma fired me for refusing to approve Gupta deals – Nhlanhla Nene

JOHANNESBURG (Reuters) &#8211; South Africa has signed an extradition treaty with the United Arab Emirates, the justice minister said on Thursday, raising the prospect of the Gupta brothers, friends of former president Jacob Zuma, returning to face corruption charges.
The Indian-born brothers &#8211; Ajay, Atul and Rajesh &#8211; have been accused of using their ties with Zuma to siphon off billions of rand in state funds and of inappropriately influencing cabinet appointments.
The Guptas are believed to be in Dubai where they own property and businesses and police have issued an arrest warrant for Ajay Gupta over a corruption case.
The Guptas and Zuma, who have repeatedly denied wrongdoing, could not be reached for comment.
Justice Minister Michael Masutha told Reuters that treaties on extradition and legal assistance had been signed with his counterpart Sultan Saeed Al Badi on Tuesday in Abu Dhabi.
“I will not at this stage comment on individual matters,” Masutha said when asked about the Guptas.
A long-awaited inquiry into allegations of inappropriately influencing government decisions, known locally as “state capture”, opened last month with witnesses testifying that the Gupta brothers tried to bribe or threaten them.
The Guptas left South Africa earlier this year around the time Zuma resigned under pressure from his own party.
Activists, opposition politicians and members of the ruling African National Congress have been calling for an extradition treaty to be agreed with the UAE so the Gupta brothers can be ordered to return to South Africa.
“This means the infamous Guptas are fast running out of places to hide as they can now face extradition to finally answer for state capture,” said Natasha Mazzone, Democratic Alliance shadow minister on state companies.

Africa&#8217;s largest electricity supplier, Eskom has finalised a settlement agreement with the world’s largest management consultancy, McKinsey for R1 billion ($74 million).
As Trillian, was not party to the settlement, Eskom said it will continue to pursue the recovery of the remainder of the payments made to Trillian through a legal review process launched earlier this year.
Eskom asked the consultancy firms McKinsey and Trillian to pay it back 1.6 billion rand ($117 million), last year after an internal inquiry found that the state power utility’s decisions to make the payments were unlawful.

Last year South Africa’s political opposition party, the Democratic Alliance alleged McKinsey steered funds to Trillian, a company which at that time was connected to the Guptas, a trio of Indian businessmen who South Africa’s anti-graft watchdog has alleged used their links with than President Jacob Zuma to win government contracts.
The Guptas denied any wrongdoing, saying they were pawns in a plot against Zuma, who  also denied any wrongdoing.
McKinsey ended up earning around 1 billion rand and Trillian 564 million rand for a “Turnaround Plan” carried out at Eskom between January and July 2016.
McKinsey says it stopped working with Trillian after the company failed due diligence in March 2016.
The size of the contract &#8211; $120 million for six months of advice &#8211; was heavily-criticized.
U.S. business advisory Oliver Wyman found in a December 2016 report commissioned by Eskom that McKinsey’s contract with the utility was “very unusual” and charged fees at more than double market rates.
In a media statement, on Friday Eskom said &#8220;the process has taken longer than what would have been ideal however it was of importance that we ensure that an appropriate and transparent legal process is followed&#8221;.
“This is a significant milestone for the Board as we seek to fulfil what we see as our non-negotiable mandate to root out financial mismanagement and malfeasance as a critical foundation to restoring transparent and effective governance” said Jabu Mabuza, Eskom Board Chairman.
“We are thankful that this hard and difficult journey has yielded positive results. We are equally appreciative of the support and cooperation we have received from McKinsey and the AFU. This for us further demonstrates that we are serious about consequence management and achieving a renewed culture of accountability and good governance which is key to our sustained success,” said Eskom Group Chief Executive Phakamani Hadebe.

JOHANNESBURG/CAPE TOWN, Feb 19 (Reuters) &#8211; Atul Gupta, one of three Gupta brothers being investigated for corrupt links to ousted South African president Jacob Zuma, is challenging a court order freezing 10 million rand ($859,025) in his bank account, according to court papers seen by Reuters.
South African prosecutors were authorised to freeze 220 million rand, including 10 million which they said was illegally transferred to Atul Gupta’s bank account, as part of an investigation into fraud at a state-backed dairy project in the Free State province.
The three Gupta brothers, accused by the public anti-graft watchdog of using their friendship with Zuma to influence policy and amass wealth, have denied any wrongdoing, as has Zuma.
In the court papers filed in a court in the Free State province, Atul Gupta denied having received 10 million rand as alleged by prosecutors and said he was “currently outside South Africa.” The affidavit attached to the court papers was signed on Feb. 8 at the South African consulate in Dubai.
A spokesman for the National Prosecuting Authority confirmed the veracity of the court papers. A lawyer authorised to speak for Atul Gupta could not be reached for comment.
Police are searching for Ajay Gupta, Atul’s brother who has been declared a “fugitive from justice,” as part of their investigation into the dairy project.
However, the police aren’t looking for Ajay, a spokesman for the elite police unit, the Hawks, which targets organised crime and corruption, said on Friday. Johannesburg’s main airport said on Friday that Ajay Gupta had left South Africa for Dubai on Feb. 6. Last week, the Hawks raided several Gupta properties in Johannesburg as part of the investigation into the Vrede dairy. The project was meant to benefit the local community but prosecutors described it as a “scheme designed to defraud and to steal”.
Relations between the Guptas and Zuma, who resigned last week after being instructed to do so by the ruling African National Congress party, are the focus of a separate judicial inquiry into high-level state corruption.
A top judge will investigate whether the Guptas sought to influence the appointment of cabinet ministers and were unlawfully awarded state tenders.
South Africa’s new president, Cyril Ramaphosa, has made fighting corruption a top priority.

In the last few hours South Africa’s top investigators the Hawks have swooped on the compound of the controversial Gupta family in Saxonwold Johannesburg &#8211; the family with strong links to President Zuma.

Hawks spokesperson gives update Gupta family arrests

Heavily armed South African police raided the luxury home of the Gupta family on Wednesday as part of a probe into allegations the three brothers had corrupt links with President Jacob Zuma, who has been ordered by the ruling ANC to quit as head of state.

The raid, which the state broadcaster said resulted in two arrests including one Gupta family member, came amid reports Zuma was preparing to tell South Africa he was stepping down after nine years in office dogged by scandal and economic stagnation.
Finance Minister Malusi Gigaba said Zuma would speak at 0800 GMT and satellite trucks were in position at Pretoria’s Union Buildings, the seat of the country’s government. Zuma’s office said there was no “official communication” of any impending address but urged media to wait.
The raid on the Gupta’s compound marks a dramatic escalation in the pressure on Zuma and the political faction around him accused of milking state resources for their own ends.
A dozen officers from the elite Hawks police unit sealed off a street leading to the Gupta home in Johannesburg’s upscale Saxonwold suburb. One officer blocked access to Reuters, saying: “This is a crime scene.”
Minutes later, an unmarked police van left the compound as residents applauded police officers and hurled abuse at security guards for the Guptas, who have been accused by South Africa’s top anti-corruption watchdog of influence-peddling and swaying the appointment of cabinet ministers.
“Finally something is being done about it. These guys must get out of our country. They must leave us alone. They have done enough damage,” said Tessa Turvey, head of the local residents’ association, standing outside.
On Tuesday, the ruling African National Congress (ANC) ordered Zuma to step down as president of the country, giving him no firm deadline but saying the party was sure he would comply and “respond” on Wednesday.
Zuma and the Guptas &#8211; a family of wealthy Indian-born businessmen &#8211; deny any wrongdoing.
A lawyer for the Gupta family said he could not comment on the raid because he had yet to see the search warrant.
Hawks spokesman Hangwani Mulaudzi said the raid was part of an investigation into allegations of influence peddling. The allegations are also the subject of a judicial inquiry on wider corruption dubbed “state capture” in local media.
“We’re not playing around in terms of making sure that those who are responsible in the so-called state capture, they take responsibility for it,” Mulaudzi said.
He declined to give details of what was seized or if the business premises of the Guptas, whose commercial empire stretches from mining to media, would also be raided, saying a full statement would be released later.
“DISCIPLINED MEMBER”
Signs of law enforcement mobilizing against the Guptas &#8211; and by association Zuma &#8211; caused the rand to strengthen 0.5 percent against the dollar. The currency has tended to gain ground on any sign of Zuma’s political departure approaching.
So far there has been silence from Zuma in response to Tuesday’s ANC order, suggesting a power struggle behind the scenes with new party leader Cyril Ramaphosa.
Besides his controversial relationship with the Guptas, Zuma has 783 counts of corruption outstanding against him relating to a multi-billion dollar state arms deal in the late 1990s.
Zuma’s spokesman could not be reached for comment.
ANC spokesman Pule Mabe told state broadcaster SABC that Zuma remained “a disciplined member of the ANC and would do what is best for a cadre of the movement”.
Besides the pressure from the ANC, Zuma is facing a no-confidence motion in parliament brought by the opposition Economic Freedom Fighters and set for Feb. 22.
The ANC could throw its weight behind such a vote if Zuma, who has survived several no-confidence motions in the past, refused to resign. The entire Cabinet would have to step down if such a vote went through.

South African police raid Gupta home, pressure cranks up on Zuma

South Africa’s rand firmed on Wednesday on expectations President Jacob Zuma would offer his formal resignation after the ruling African National Congress (ANC) party ordered the 75-year old to step down.

At 0714 GMT, the rand was 0.8 percent firmer at 11.8590 to the dollar.
Zuma is expected to respond on Wednesday to the ANC’s order to step down as head of state, party officials said, after the party gave him no firm deadline to resign.
“After waiting for so long for such a major event, we still think that a formal resignation/removal will trigger some sharp gains, even if only temporarily,” Rand Merchant Bank analyst John Cairns said in a note.
The presidency told the media on Wednesday to “await official notification” of a briefing by Zuma, amid expectations of his resignation.
Gains were supported after a police unit raided the home of the Gupta family, wealthy friends of Zuma, with local police reporting that one member of the family has been arrested.
The Guptas are accused by the public anti-graft watchdog of using their friendship with Zuma to influence policy and amass wealth. They have denied any wrongdoing.
Bonds were stronger with the yield on the benchmark 2026 government issue down 5.5 basis points to 8.400 percent.
Stocks were firmer, with the Johannesburg bourse’s index of 40 blue-chip stocks up 0.3 percent to 50,540 points, while the All-Share index lifted 0.21 percent to 57,330 points

NPA won’t act yet on Guptas

Canada’s trade financing agency Export Development Canada (EDC) said on Thursday it has scrapped a deal to help finance the sale of a Bombardier Inc jet to the wealthy Gupta family in South Africa.

The Guptas failed to meet loan repayment obligations in recent weeks and, with the EDC assessing a “political exposure” risk, it terminated the loan which allowed Canada’s Bombardier to sell a Global 6000 jet to them, the Globe and Mail had reported earlier.
Under a December 2014 agreement, the Canadian government’s export agency was financing 80 percent of the C$52 million ($41 million) cost of the aircraft, according to the Globe and Mail.
“I can confirm that the contract has been terminated,” Shelley Maclean, a spokeswoman for Export Development Canada said in an email when asked about the Globe and Mail’s story.
Bombardier said EDC was an an important partner. “We support them in exercising their policies as they see fit,” it said in an emailed statement.
The Gupta family could not immediately be reached for comment.
South African President Jacob Zuma has faced allegations that his friends, the businessmen and brothers Ajay, Atul and Rajesh Gupta, have wielded undue influence over his government including influencing appointment of ministers.
Zuma and the Guptas have denied the accusations.
Last week, South Africa’s High Court ruled that Zuma must set up a judicial inquiry into state influence-peddling, the latest in a series of judicial blows to his scandal-tinged administration.
